Ευρωπαϊκή Οδηγία για τις Μηχανές 2006/42/EC - Machinery Directive

Η Οδηγία για τις Μηχανές, προβλέπει για τον κατασκευαστή (αυτός που διαθέτει το µηχάνηµα στην αγορά µε το όνοµά του) τις καθιερωµένες για Οδηγία Νέας Προσέγγισης υποχρεώσεις (αξιολόγηση της συµµόρφωσης και συµµόρφωση του µηχανήµατος, σύνταξη της δήλωσης συµµόρφωσης, επίθεση της Σήµανσης CE).

H Οδηγία προβλέπει επίσης ότι, στις περιπτώσεις όπου δεν υπάρχει κατασκευαστής ή εξουσιοδοτηµένος αντιπρόσωπός του, ως κατασκευαστής θεωρείται το φυσικό ή νοµικό πρόσωπο που διαθέτει στην αγορά ή αρχίζει να χρησιµοποιεί µηχανήµατα.

Τα µηχανήµατα συνοδεύονται κατά τη διάθεσή τους στην αγορά µε τη δήλωση συµµόρφωσης του κατασκευαστή, ενώ τα ηµιτελή µηχανήµατα συνοδεύονται µε τη βεβαίωση ενσωµάτωσης.

The Machinery Directive provides for the manufacturer (the one who places the machinery on the market under his own name) the obligations established for a New Approach Directive (conformity assessment and conformity of the machinery, drawing up the declaration of conformity, affixing the CE marking).

The Directive also provides that, in cases where there is no manufacturer or authorised representative, the natural or legal person who places machinery on the market or puts it into service is considered to be the manufacturer.

When machinery is placed on the market, it is accompanied by the manufacturer's declaration of conformity, while partly completed machinery is accompanied by the certificate of incorporation.
